Statement on the Privacy of Customer Information
The Tri-County Bank respects the privacy expectations and rights of its customers regarding financial information and other related information which the Bank has or gathers in the normal course of business.
The Tri-County Bank collects information you might consider to be private, such as account number(s), social security number(s), income and net worth about you, non public-personal information, from the following sources:
- Information we receive from you on applications or other forms;
- Information about your transactions with us, our affiliates or others; and
- Information we receive from a consumer reporting agency.
The Tri-County Bank restricts access to your personal and account information to those employees who need to know that information to provide products and services to you. We maintain physical, electronic and procedural safeguards that comply with federal standards to guard your nonpublic personal information.
The Tri-County Bank may disclose personal and account information about you to our departments or related entities, the Tri-County Insurance Agency and the Tri-County Financial Center.
The Tri-County Bank may disclose personal and account information to financial service providers, such as insurance agents who are affiliated with us. We may disclose information based on our transactions and experiences with you, such as:
- Name
- Account activity
- Payment
- Address
- Types of accounts
- Deposit history
- Account balances
- Credit card usage
- Parties to the transaction
Since The Tri-County Bank values our customer relationship with you, we will not disclose your personal and account information to other third parties, except as permitted by law, such as reports to credit bureaus, IRS Reporting, responses to subpoenas, search warrants or summons.
If you decide to close your account(s) or become an inactive customer, we will follow the privacy policies and practices as described in this notice.

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
This Notice of Privacy Practices describes the practices of The Tri-County Bank, Tri-County Insurance Agency, and Tri-County Financial Center for safeguarding individually identifiable personal health information.
We are required by law to maintain the privacy of our customers' personal health information and to provide notice of our legal duties and privacy practices with respect to personal health information. We are required to abide by the terms of this Notice as long as it remains in effect. We reserve the right to change the terms of this Notice as necessary and to make the new Notice effective for all personal health information maintained by us.
Uses and Disclosures of Your Personal Health Information
Authorization. Except as explained below, we will not use or disclose your personal health information for any purpose unless you have signed a form authorizing a use or disclosure. Unless we have taken any action in reliance on the authorization, you have the right to revoke an authorization if the request for revocation is in writing and sent to: The Tri-County Bank, P.O. Disclosures for Applications and Claims. We may disclose your personal health information as necessary for insurance underwriting and claim adjustment. For instance, an insurance company involved in underwriting or claim adjustment may request your personal health information in our possession to assist them in underwriting your application or settling a claim.
Uses and Disclosures for Payment. We will use and disclose your personal health information as necessary for claim purposes. For instance, we may use your personal health information to assist you in filing a claim. We may also forward information to another insurer in order for it to process or pay claims on your behalf.
Uses and Disclosures for Insurance and Investment Operations. We will use and disclose your personal health information as necessary for insurance operations. For instance, we may use or disclose your personal health information for quality assessment and quality improvement, premium rating, conducting or arranging for medical review or compliance. We may also disclose your personal health information to another insurer company.
Other Health-Related Uses and Disclosures. We may contact you to provide reminders for appointments; or other health-related programs, products or services that may be available to you.
Information Received Pre-enrollment. We may request and receive from you and your health care providers personal health information prior to your application. We will use this information for application purposes only.
Business Associate. Certain aspects and components of our services are performed by outside people or organizations pursuant to agreements or contracts. It may be necessary for us to disclose your personal health information to these outside people or organizations that perform services on our behalf. We require them to appropriately safeguard the privacy of your personal health information.
Family, Friends and Personal Representatives. With your approval, we may disclose to family members, close personal friends, or another person you identify, your personal health information relevant to their involvement with your care or paying for your care. If you are unavailable, incapacitated or involved in an emergency situation, and we determine that a limited disclosure is in your best interests, we may disclose your personal health information without your approval. We may also disclose your personal health information to public or private entities to assist in disaster relief efforts.
Other Uses and Disclosures. We are permitted or required by law to use or disclose your personal health information, your authorization, in the following circumstances:
- For any purpose required by law;
- For public health activities (for example, reporting of disease, injury, birth, death or suspicion of child abuse or neglect);
- To a governmental authority if we believe an individual is a victim of abuse, neglect or domestic violence;
- For health oversight activities (for example, audits, inspections, licensure actions or civil, administrative or criminal proceedings or actions);
- For judicial or administrative proceedings (for example, pursuant to a court order, subpoena or discovery request);
- For law enforcement purposes (for example, reporting wounds or injuries or for identifying or locating suspects, witnesses or missing people);
- To coroners and funeral directors;
- For procurement, banking or transplantation of organ, eye or tissue donations;
- For certain research purposes;
- To avert a serious threat to health or safety under certain circumstances;
- For military activities if you are a member of the armed forces; for intelligence or national security issues; or about an inmate or an individual to a correctional institution or law enforcement official having custody; and
- For compliance with workers' compensation programs.
We will adhere to all state and federal laws or regulations that provide additional privacy protections. We will only use or disclose AIDS/HIV-related information, genetic testing information and information pertaining to your mental condition or any substance abuse problems as permitted by state and federal law or regulation.
Your Rights
Restrictions on Use and Disclosure of Your Personal Health Information. You have the right to request restrictions on how we use or disclose your personal health information. In accordance with Section 326 of the USA PATRIOT Act signed October 26, 2001 and effective October 1, 2003, The Tri-County Bank is required to obtain a copy of the documents used in identifying our new account customers and in identifying signatory individuals added to an existing or new account. In some cases, identification will be requested for those individuals banking with The Tri-County Bank prior to the effective date of customer identification requirements because original documentation was not obtained with the opening of the account, or The Tri-County Bank is unable to form a reasonable belief that it knows the true identity of the existing customer. In all cases protection of our customer's identity and confidentiality is The Tri-County's pledge to you.
AFS Brokerage
Privacy Policy Statement
AFS Brokerage, Inc. ("AFSB") understands that customers and consumers (hereinafter jointly referred to as "customers") expect businesses to use their customer information discretely, affording such information the privacy protection that it deserves. Unless otherwise contemplated herein, AFSB will not sell or distribute confidential customer information to unaffiliated third parties for purposes of solicitation. However, AFSB may provide access to such information to specified parties in order to effectively and efficiently conduct its business.
There are a few instances in which customer information will be used in order to process business in an efficient and effective manner. First, if a customer who has a brokerage account at AFSB also has an annuity or insurance product that was sold by an agent of Affiliated Financial Services, AFSB may utilize such information to the extent permitted by applicable regulations. It could be used by representatives of AFSB who are also agents or employees of Affiliated Financial Services. Such information may be used, for example, to determine (i) whether the insurance product or insurance security sold is appropriate or suitable for the customer or (ii) whether the customer may elect to avail himself or herself of certain policy options.
Another example of how AFSB shares information with other parties involves its securities execution and processing services. In the ordinary course of business, AFSB utilizes the processing services of its clearing firm, Southwest Securities ("SWS"), as well as mailing and other processing or data management services of third parties. Because of the way that AFSB is structured, AFSB must utilize a clearing firm such as SWS. AFSB utilizes SWS to engage in trading, clearance and settlement of customer business. AFSB customer account agreement(s) contemplate this relationship. SWS utilizes other companies to fulfill processing, servicing and record retention functions. Such business relationships help AFSB administer its business and provide services and other opportunities to customers, as well as to fulfill certain regulatory requirements contemplated within the securities industry. Such parties are instructed to exercise similar discretion in deference to your privacy rights. If the customer does not consent to these arrangements, the customer may accordingly send AFSB notification, which will result in the accounts' closure. If the customer notifies AFSB that it may not share information with its clearing firm, please be advised that AFSB will have to close the account because it does not have any efficient or effective alternatives to process the business. Please note that in the ordinary course of business, many broker-dealers utilize clearing firms such as SWS, which handle such information in a confidential manner.
AFSB has contractual relationships with financial services organizations, including community banks, insurance companies and agencies, as well as potentially with other service corporations, to sell securities from their premises. The securities sales representatives located at the respective financial services organizations are typically employees of such organizations and independent agents of AFSB. Such representatives are instructed to afford customer information all due protection. AFSB provides customers the ability to opt-out of the sharing of customer information between the financial services organizations and AFSB. Such opt-out statements can be found on AFSB's Investor's Disclosure Checklist and the SWS Privacy Policy Statement, found at www.swst.com (click on Privacy Policy at the bottom of the page). If the customer does opt-out, then the AFSB sales representatives may not obtain any information from their financial services organizations to utilize in the brokerage environment. For example, if the customer does opt-out, sales representatives may not obtain social security numbers, suitability and financial information, tax brackets, spelling of names, phone numbers, addresses, among other things, from the financial service organizations' records to assist in the completion of AFSB account forms or in the solicitation or contacting of prospective customers. If the customer has opted-out, AFSB sales representatives located in banks should not obtain lists of Certificate of Deposit customers and other bank account holders in order to solicit securities business. Sales representatives must establish a separate relationship with the respective customers anew. If the customer does not consent to this sharing of information, sales representatives may not sell, or provide in any way, customer information to any third party, excepting AFSB and the clearing firm.
AFSB may also use other service corporations for mailing and other processing-related services.AFSB will impress upon such parties the confidential nature of such information and obtain a written agreement from such parties to treat the information as such.
AFSB regards customer information as confidential and treats it accordingly. If it shares such information with any other parties, it is being done exclusively for the purpose of being able to better serve you. Any recipients of such information are instructed to treat the information in a confidential manner. The circumstances mentioned above include those situations that enable AFSB to be able to provide the customer with better products and services.
